  • 90 days to 1 year (first offense)
  • 180 days to 2 years (subsequent offense)
  • 1 to 2 years (if second offense is within 5 years)

Driving While Intoxicated with Child Passenger  – Suspension on Conviction

  • 90 days to 1 year

Intoxication Assault (By a Motor Vehicle) – Suspension on Conviction

  • 90 days to 1 year (first offense)
  • 180 days to 2 years (subsequent offense)
  • 1 year (second offense within 5 years)

Intoxication Manslaughter – Suspension on Conviction

  • 180 days to 2 years (first offense)
  • 1 to 2 years (second or subsequent offense within 10 years of offense)

Administrative Driver’s License Revocation Suspensions (21 or older)

First alcohol related or drug related enforcement contract

  • Failure case (having an alcohol concentration of 0.08 or more – 90 days
  • Refusal case (refusing request of peace officer to submit to taking of specimen)- 180 days

1 or more alcohol related or drug related enforcement contracts during the 10 years before the arrest

  • Failure case (having an alcohol concentration of 0.08 or more) – 1 year
  • Refusal case (refusing of peace officer to submit to taking of specimen) – 2 years

Administrative Driver’s License Revocation Suspensions (Under 21)

First offense  (no previous suspension for a conviction)

  • Any detectable amount case (presence of alcohol detected or alcohol concentration less than 0.08) – 60 days
  • Failure case (having an alcohol concentration of 0.08 or more – 60 days
  • Refusal case (refusing request of peace officer to submit to taking of specimen)- 180 days

Second or subsequent offense  (Previous suspension for a conviction)

  • Any detectable amount case (presence of alcohol detected or alcohol concentration less than 0.08) – 120 days if 1 previous conviction.
  • Failure case (having an alcohol concentration of 0.08 or more – 120 days if 1 previous conviction, 180 days if 2 or more previous convictions.
  • Refusal case (refusing request of peace officer to submit to taking of specimen)- 2 years, if 1 or more alcohol related or drug related enforcement contracts during the 10 years before the arrest).
